I. Application and enforceability of the general terms and conditions of sale

1.1. The present general conditions of sale are brought to the attention of each customer to enable him to place an order.

1.2. consequently, the fact of placing an order implies the customer's full and unreserved acceptance of these general conditions of sale.

1.3. No special conditions or other general conditions emanating from the customer may, without the express agreement of Villars Maître Chocolatier, prevail over these conditions.

1.4. Any condition to the contrary laid down by the client shall therefore, in the absence of express acceptance, be unenforceable against Villars Maître Chocolatier, regardless of the time at which it may have been brought to its attention.

1.5. The fact that Villars Maître Chocolatier does not avail itself at a given time of any of these general conditions of sale may not be interpreted as a waiver of the right to avail itself of any of the said conditions at a later date.

II. Order taking and confirmation

2.1. The customer undertakes to fill in the order form accurately and to fill in the various existing sections (address, delivery address, method of payment, etc.). In the event of an error in the recipient's details, Villars Maître Chocolatier cannot be held responsible for the impossibility of delivery to the recipient. The re-routing of the parcel to another recipient or to a new delivery address will be invoiced according to the destination and the weight of the order.

2.Each product request is subject to acceptance by Villars Maître Chocolatier, which reserves the right to reject any order due to insufficient stock, incomplete customer information or any other legal reason. We undertake to inform you within two (2) working days of your order, if we encounter a problem in fulfilling your order.

2.3. The right of withdrawal of 7 days does not apply to contracts for the supply of perishable products, foodstuffs, such as chocolates. Therefore, the customer cannot avail himself of this right. However, a modification or cancellation on his part may be taken into account insofar as the package is being prepared. The price will be refunded but a penalty for administrative and management costs in the amount of 10 CHF including VAT will be applied.

2.4. On the other hand, from the moment the package is handed over to the carrier, no modification or cancellation can be taken into account and the price paid will not be refunded.

III. Prices

3.1. The prices indicated on the order form are in Swiss Francs (CHF), including VAT, from our factory and shop in Fribourg. The Swiss VAT of 2.5% on products and 7.7% on packaging and shipping costs apply to all orders. The general prices may be revised freely by Villars Maître Chocolatier.

3.2. Delivery costs are extra.

IV. Payment with the order

4.1. Payment is made online in cash by Visa, Mastercard, Postfinance, Paypal, American Express or Twint (Swiss card). For this reason, no discount conditions or penalties for late payment are applied.

4.2. The currency used for the transaction is the Swiss Franc (CHF).

4.3. To be registered, the order must be paid in full. Unpaid orders cannot be delivered.

4.4. The invoice for the order placed is available in the "My Account" section.

VI. Unavailability of products

The availability of products and services is given on the site as an indication. It only becomes definitive once the order has been confirmed. Villars Maître Chocolatier cannot be blamed for the unavailability of a product during delivery, insofar as the customer has been informed (via email) prior to the delivery of his order.

VII. Delivery of products

7.1. Preparation and routing of products

7.1.1. Parcels are prepared and packaged by Villars Maître Chocolatier in closed, strong packaging appropriate to the contents and transport requirements.

7.1.2. THE CUSTOMER IS RESPONSIBLE FOR THE NAME AND ADDRESS OF THE RECIPIENT, WHICH MUST BE ACCURATE, ACCURATE AND COMPLETE (DOOR CODE, FLOOR, TELEPHONE, etc.) in order to allow delivery under normal conditions. Villars Maître Chocolatier cannot be held responsible for a return delivery due to an address error or the impossibility of delivering to the address indicated. IF THE RETURN DELIVERY OR THE IMPOSSIBILITY TO DELIVER IS DUE TO A LACK OF INFORMATION OR AN ADDRESS ERROR, THE RE-DELIVERY WILL BE CHARGED AT THE PRICE OF THE TRANSPORT PREVIOUSLY PAID.

7.1.3. ATTENTION: Orders indicating a P.O. Box address cannot be taken into account.

7.1.4. Once the order has been confirmed, Villars Maître Chocolatier undertakes to process and deliver the order to the agreed destination, according to the route, procedure and carrier chosen. Villars Maître Chocolatier insures the goods up to the delivery point, but it is up to the recipient to check the parcel in the presence of the delivery person. Any anomaly during delivery must be indicated on the delivery note. If this clause is not respected, no reimbursement procedure with the chosen carrier can be initiated.

7.1.5. IN THE ABSENCE OF THE RECIPIENT OR OF A PERSON WHO CAN TAKE POSSESSION OF THE PRODUCTS AT THE TIME OF DELIVERY, THE CARRIER WILL LEAVE THE PACKAGE IN THE ANNEX COMPARTMENT, OR WILL LEAVE A NOTICE OF PASSAGE at the delivery address indicated by the customer inviting him to collect the products. Under no circumstances can Villars Maître Chocolatier be held responsible for any deterioration in the products due to their late collection from the carrier.

7.1.6. The logistics centre for the preparation of orders is located at the following address Villars Maître Chocolatier - Rte de la Fonderie 18 - 1700 Fribourg - Switzerland.

7.1.7 Villars Maître Chocolatier cannot be held responsible if the product has not been delivered for the following reasons: force majeure as defined by the courts and natural disasters.

7.2. Delivery times

7.2.1. Delivery times depend on the day of the week and the period of the year. For information purposes only, here are the delivery times in working days.

Monday to Friday

Orders placed before noon - Delivery within two working days.

Your order placed after midday - Delivery within three working days.

Saturday and Sunday

Your order delivered within three working days

Saturday delivery

Saturday delivery is only possible for orders placed before noon on Thursday, and for a supplement of 4.20 chf. 

These times are guaranteed:

      • excluding cases of force majeure
      • except in the event of a carrier strike
      • provided that the delivery address is precise, exact and complete,
      • provided that the person receiving the order is present at the time of delivery
      • outside the high season period

These deadlines are not guaranteed for orders placed on public holidays in Fribourg, Switzerland. Deliveries are made on non-holiday working days in the canton of destination. ATTENTION: NO DELIVERIES WILL BE MADE ON SUNDAYS.

During busy periods, delivery times cannot necessarily be guaranteed.

VIII. Sale of AteliersLa Fabrik Experience Boutique

8.1. Experience boutique workshop

La Fabrik Workshops can be booked via the Villars Maître Chocolatier website (www.villars.com/les-ateliers-la-fabrik), subject to availability and the opening days of the La Fabrik Experience Boutique.

Registration can be made as long as the workshop is open for booking on the Villars Maître Chocolatier website.

Registration becomes definitive, subject to receipt of payment for the service by credit card, on the date on which a confirmation email is sent by Villars Maître Chocolatier. Villars Maître Chocolatier reserves the right to cancel a reservation at any time if the Customer's bank details are inaccurate.

If one or more services become unavailable after the order has been placed, Villars Maître Chocolatier will inform the Customer as soon as possible by telephone, which may be followed by a confirmation e-mail or letter. Villars Maître Chocolatier will propose a new date to replace the cancelled service, subject to availability, and the Customer may either cancel the order (at least 7 days before the date of the workshop) and have any payment made refunded, or accept the new date proposed.

8.2. Conditions for the Workshops

Each participant must have a paper or electronic ticket.

This ticket must be presented directly upon arrival at La Fabrik Experience Boutique.

Please arrive 15 minutes before the start of your workshop.

If you are late, the workshop may start without you. We reserve the right to refuse entry to the workshop if you are more than 10 minutes late.

For safety reasons, children under the age of 8 are not admitted to the workshop.

Your workshop starts at the time shown on your booking email.

In the event of force majeure or technical problems, your workshop may be delayed.

8.3. Prices and payment terms

The price in force for each service or ticket is that shown on the day of booking on the www.villars.com/les-ateliers-la-fabrik website.)

Prices are expressed in Swiss francs and include VAT.

Payment for the service or ticket on our website is due on confirmation of the order. Any registration that is not paid for within this period will be cancelled.

Payment on the Villars Maître Chocolatier booking site can be made by credit card (Mastercard, Visa American Express), PayPal or Twint.

8.4 Cancellation of services by Villars Maître Chocolatier

Villars Maître Chocolatier reserves the right to cancel a service in the event of force majeure and cannot be held liable for such cancellation.

Villars Maître Chocolatier also reserves the right to cancel a service if the minimum number of participants is not reached, up to 2 working days before the date of the service. In this case, Villars Maître Chocolatier will propose a new date to replace the cancelled service, subject to availability.

If the Customer cancels 7 calendar days or less before the date of the service, the payment for the workshop will only be refunded in the form of a voucher.

If the customer cancels or changes the number of participants less than 24 hours before the workshop, the full price will be charged.

If the Customer DOES NOT SHOW up, the workshop fee will not be reimbursed. Unless the right of withdrawal referred to in paragraph 1 above is exercised, no refund will be made for any service not taken up by the Customer, with the exception of cases of force majeure, proof of which must be provided to Villars Maître Chocolatier (medical certificate, etc.).

A case of force majeure is considered to be any external factor that cannot be anticipated and controlled by the Customer (weather event preventing any travel, illness of the Customer, death of a close relative or child).

8.5 Personalised/Group services

Any registration for a personalised group service must be the subject of a specific reservation request to Villars Maître Chocolatier, and will be subject to specific conditions of sale for group reservations. Villars Maître Chocolatier reserves the right to refuse this request if the dates requested by the participants are not compatible with the general schedule of Villars Maître Chocolatier activities. In this case, Villars Maître Chocolatier will do its utmost to propose another date for this service.

8.6 Liability

Villars Maître Chocolatier reserves the right to cancel a service in the event of force majeure and may not be held liable for such cancellation. Villars Maître Chocolatier cannot be held responsible for any damage to or loss of objects and personal effects brought by the Client. At the end of the workshop, the Customer who wishes to reproduce a workshop offered by Villars Maître Chocolatier does so under his own responsibility and subject to respect for the intellectual property rights belonging to Villars Maître Chocolatier. It is the Client's responsibility to ensure that no risk arises from the preparation of the workshop or from the consumption of products that they have acquired themselves. Villars Maître Chocolatier may not be held responsible for the result of a workshop carried out by the Client, under his/her responsibility, on the grounds that it was previously proposed during a workshop.

The Customer may take the chocolates prepared during the course or workshop to be consumed outside La boutique expérience La Fabrik, on his/her own responsibility. The chocolates must be kept and consumed according to the instructions given during the workshop. Villars Maître Chocolatier cannot be held responsible for any damage resulting from the consumption of chocolates prepared in one of its workshops and consumed outside the workshop.

The Customer is required to inform the members of Villars Maître Chocolatier of any potential allergies affecting him/her. If they fail to do so, Villars Maître Chocolatier declines all responsibility in the event of an allergic reaction to one of the products or ingredients used.

8.7 Intellectual property rights

The documents published by our services are intended for individual use only and may not be reproduced or distributed. The Customer undertakes not to produce a copy or distribute, whether in paper or electronic format, without the written approval of Villars Maître Chocolatier, the content of any medium supplied as part of the service. In the absence of prior written authorisation from the holder of the protected right, any other use constitutes an infringement and is punishable under the Intellectual Property Code.

All content available on the www.villars.com website (in particular text, images, videos, photos, sound, music, software, recipes and, more generally, any type of data) is protected by the French Intellectual Property Code.

Villars Maître Chocolatier holds the copyright to these elements.

As an exception to the above rule, the following are authorised: the reproduction, representation and publication of elements of the www.villars.com website for the purposes of illustrating a press article, with the written agreement of the Villars Maître Chocolatier communications or marketing department.

8.8 Confidentiality and personal data

For all information on the processing of personal data, please refer to the page on the www.villars.com website.

IX. Transfer of ownership - transfer of risk

9.1. The transfer of ownership of the products to the customer only takes effect after full payment of the price by the latter.

9.2. Villars Maître Chocolatier assumes the risks of loss and deterioration of the products until the products are delivered to the recipient. The transfer of risks therefore takes place from the moment the recipient acknowledges receipt of the products.

X. Complaints - Disputes

10.1. Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in the person who takes the trouble to expose the dispute.

10.2. Upon receipt of the products, the customer must ensure that the delivery complies with the order. Any damage must be the subject of precise reservations, dated and signed, on the delivery slip.

10.Any complaint must be made within a maximum of 5 days of receipt, to the Villars Maître Chocolatier customer service department, by email, using the form in the "Contact" section. After this period, no complaint will be taken into account.

10.4. Villars may ask that the complaint be accompanied by proof of the loss suffered (letter of transport, photo of the package received, etc.). Once the complaint has been analysed and accepted by Villars Maître Chocolatier, the customer may choose between a refund of the order or a re-delivery.

XI. Returns

11.1. All product returns must be formally agreed between Villars Maître Chocolatier and the customer and must be returned within 14 days of the agreement. After this period, no returns can be taken into account.

11.2. Any return accepted by Villars Maître Chocolatier, in the case of an apparent defect or non-conformity of the products delivered, which is noted by Villars Maître Chocolatier, will entitle the customer to obtain a replacement free of charge to the exclusion of any other compensation or damages.

XII. Right of access and rectification

12.1. Ethics
Concerned about protecting your privacy, Villars Maître Chocolatier treats all information about you with the strictest confidentiality. When you make a purchase, we only ask you for the information that is essential (surname, first name, full address, e-mail) for quality processing and careful monitoring of your order. This data entered online is recorded on a secure server and is immediately encrypted.

12.2. Your rights
In accordance with the laws applicable to the processing of personal data (the French law of January 6, 1978 relating to data processing, files and freedoms, and the Swiss law on data protection of June 19, 1992, RS 235.1), you have a right of access, rectification, opposition and deletion of the personal data that you will have communicated by filling in the forms on the Site. XIII. Guarantees

The expiry date (DLUO) of our chocolates is indicated on the bottom of each box. Villars Maître Chocolatier guarantees the quality and freshness of its products provided they are kept in a cool place (between 14 and 20°C), away from direct light.

XIV. Prohibitions

The customer must not under any circumstances resell the products which are intended for his or her personal use or that of the person receiving the order.
